Terms of Service
These Terms of Service (the "Terms") set forth the conditions for use of the smartphone application "Odekake Note" (the "App") provided by Daisuke Kawashima (an individual; the "Operator"). By using the App, users are deemed to have agreed to these Terms.
Article 1 (Application)
These Terms apply to all relationships between the Operator and users regarding use of the App.
Article 2 (Service Overview)
The App is a service in which AI helps users create outing and travel plans based on inputs such as date, location, companions, purpose, and budget. It also provides map display, weather display, timeline display, and a memo feature.
Article 3 (Registration and Usage Environment)
1. The App operates primarily by storing data on the device. If account registration or cloud sync features are provided in the future, they will be subject to separately defined conditions.
2. Some features of the App require permission to access location information and the photo library, as well as an internet connection.
Article 4 (Prohibited Acts)
When using the App, users must not engage in any of the following:
1. Acts that violate laws or public order and morals
2. Reverse engineering, decompiling, disassembling, or otherwise analyzing the App
3. Reproducing, reselling, or redistributing the App or its output without authorization
4. Infringing on the intellectual property rights, portrait rights, privacy, or other rights of the Operator or third parties
5. Placing an excessive load on the App's servers or network, or attempting unauthorized access
6. Any other act the Operator deems inappropriate
Article 5 (Handling of AI-Generated Results)
1. Plans, spot information, estimated travel times, estimated costs, and other content generated by the App (the "Generated Results") are automatically generated based on information obtained from AI and external APIs (maps, weather, etc.), and their accuracy, timeliness, and completeness are not guaranteed.
2. Because store business hours, reservation availability, prices, congestion, and similar details may change, users should check official information before visiting.
3. Except in cases of intentional misconduct or gross negligence by the Operator, the Operator is not liable for the outcome of any action taken based on the Generated Results.
Article 6 (Fees and Charges)
1. The App's basic features are available free of charge. Some features are offered as a paid plan (Paid Plan: ¥400/month; Extra Ticket: ¥100 each).
2. Purchases of paid features are made through Apple's In-App Purchase, and pricing follows what is shown on the App Store.
3. Refunds are subject to Apple's refund policy; the Operator does not process refunds directly.
Article 7 (Handling of Location Information and Stored Data)
1. Plans, memos, photos, and other data created in the App are, in principle, stored on the device.
2. Location information is used only for purposes such as searching for nearby spots, setting meeting places, and calculating travel time.
3. Details on the handling of data are set forth in the Privacy Policy.
Article 8 (Use by Minors)
Minor users must obtain the consent of a parent or other legal guardian before using the App.
Article 9 (Suspension, Modification, and Termination of the App)
The Operator may modify the content of the App, or suspend or terminate its provision, without prior notice to users. The Operator is not liable for any damages users may incur as a result.
Article 10 (Disclaimer)
1. The Operator does not warrant, expressly or implicitly, that the App is free of factual or legal defects.
2. The Operator is not liable for damages incurred by users due to circumstances beyond the Operator's control, such as sudden weather changes, transportation delays, or store closures.
3. Except in cases of intentional misconduct or gross negligence by the Operator, the Operator is not liable for damages incurred by users.
Article 11 (Response to Violations)
If the Operator determines that a user has violated these Terms, the Operator may restrict or suspend the user's use of the App without prior notice.
Article 12 (Changes to the Terms)
The Operator may change these Terms without prior notice to users when deemed necessary. The revised Terms take effect once announced within the App or by a method designated by the Operator.
Article 13 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Operator's location as the court of first instance.
